My brother just made a valid point about something....
If Pokemon was real.... then it would be illegal to catch them up and use them to fight against each other...
Techincally, it would be like dog-fighting...

Yeah PETA would actually be after people for that one. But if it was anything like the Pokemon World, we'd have Pokemon Centers as well to heal them and the general consensus that Pokemon are companions and partners. So battling probably would be rarer but still there considering Pokemon are said to still be competitive even without trainers. Especially seeing as how many of the attacks will probably be a bit more deadly than what they show in the anime.
Even excluding their supernatural abilities they are unlike any animal currently on the planet. Having a virtually full understanding of the human language brings them to a different status then dogs, cats, or dolphins. It makes sense what you are saying, and even more-so with my points, so it's hard to really say what the laws would be like.
In the environment you currently are in, what Pokemon shall you find right now in the wild?
Like others I'm in the suburbs but live less than a block away from a park. So Normal, Flying, Grass, Water, and Bug would probably be the most common.

I'd beg to differ. I feel that the existence of such creatures as pokemon would greatly alter the development of the modern legal system, to a point where any worry of being in trouble with the law for a pokemon related issue would be near unheard of.

Well, I could see it going either way. But, then there's the fact that we could send Pokemon off to war. I mean, you've got Lt. Surge and the armored Pokemon in the Lucario movie.

Not to change the topic too much but it would take more than Pokemon to bring about world peace right now. In fact as is it's currently impossible. There are a few major obstacles that need to be overcome before that goal is reached and people aren't willing to let go what they need to to achieve this anytime soon. Something seriously major would have to happen for us to see world peace in our generation, as sad as it sounds.
Pichu - I think that we kinda made mention of war earlier because I remember mentioning a few things of that nature earlier.

Actually, that brings up a question: What Pokemon Region would you live in?
I get that Unova's supposed to based on NYC and several other areas in the US, but I refuse to live in the Unova Region. It'd probably be Hoenn or Johto.
